KidzBrainy Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of the KidzBrainy website, educational web demonstrations, Android applications and related services (collectively, the “Services”) published by Learn With Fun Studio (“we”, “us” or “our”).
By accessing or using a Service, an adult user agrees to these Terms. Where a child uses a Service, a parent or legal guardian should review these Terms and supervise the child’s use.
1. Eligibility and parental supervision
Our educational games may be intended for children. A parent, legal guardian or teacher is responsible for deciding whether a Service is suitable for a particular child and for supervising the child’s use where appropriate.
Children should not independently submit contact forms, make purchases, follow external links or provide personal information. Adult-only sections and external actions should be handled by a parent or guardian.
2. Educational purpose
KidzBrainy provides educational and entertainment content that may help children practise letters, numbers, words, tracing, maths, Tamil, memory, matching, puzzles and related skills.
The Services are supplementary learning resources. They do not replace school instruction, professional teaching, medical advice, developmental assessment, therapy or specialist learning support. Learning outcomes vary between children and are not guaranteed.
3. Permission to use the Services
Subject to these Terms, we grant users a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable permission to access and use the Services for lawful, non-commercial learning and family use.
This permission does not transfer ownership of any application, web build, artwork, source code, audio, text, design, brand or other material.
4. Ownership and intellectual property
The Services and their original content, software, artwork, animations, characters, audio, game mechanics, interfaces, documentation, trademarks and branding are owned by Learn With Fun Studio or used with permission from their respective owners. They are protected by applicable intellectual-property laws.
“KidzBrainy” and associated logos and designs may not be used in a way that falsely suggests endorsement, partnership or ownership.
5. Prohibited use
Users must not:
- Copy, resell, redistribute, republish or publicly host our Apps, web builds or protected assets without written permission;
- Reverse engineer, decompile, extract, modify or create derivative versions except where applicable law expressly permits it;
- Circumvent security, parental controls, access restrictions or technical protection measures;
- Introduce malicious code, overload the Services, scrape content abusively or interfere with normal operation;
- Use the Services for unlawful, fraudulent, harmful or commercial exploitation;
- Impersonate Learn With Fun Studio, KidzBrainy or another person; or
- Submit spam, abusive material or unnecessary personal information about a child.
6. Apps, demos and availability
A web demo may include fewer activities, different controls or limited progress compared with an Android app. Information on the website may describe a product that is still being developed.
Labels such as “Coming Soon”, “In Development” or “Planned” do not represent a promise that a product will be released on a particular date or with every described feature.
We may improve, replace, restrict, suspend or discontinue a Service or feature. We do not guarantee continuous availability or compatibility with every device, operating-system version, browser or internet connection.
7. Local progress and device settings
Some Apps may store scores, completed activities, settings and progress locally on the device. Local information may be lost if the App is removed, its storage is cleared, the device is reset or the software is changed.
Unless an App expressly provides a cloud-backup feature, we are not responsible for restoring local progress. Parents and guardians are responsible for device controls, backups, internet access, volume and other device settings.
8. Advertising and purchases
Our current initial Apps may be released without third-party advertising or in-app purchases. The relevant store listing and App screens will describe whether a particular release contains advertisements or purchases.
If purchases are introduced, an adult account holder is responsible for purchase decisions, device authentication and payment settings. Purchases made through Google Play are also governed by Google Play’s payment, refund and account terms.
If advertising or commercial content is introduced in a child-directed App, we will implement applicable child-safety, disclosure and parental-control requirements.
9. External services and links
The Services may link to Google Play, our website, social-media accounts, video platforms or other third-party services. Those services are governed by their own terms and privacy policies.
We do not control and are not responsible for the availability, security, content or practices of independent third parties. Parents and guardians should supervise external links and review the relevant provider’s terms.
10. Feedback and communications
Parents, guardians, teachers and other adults may send us questions, suggestions or feedback. Do not send confidential material or unnecessary personal information about a child.
You grant us permission to use general, non-confidential suggestions to improve our Services without payment or obligation to you. This does not transfer ownership of personal information or material clearly identified as confidential.
11. Updates and changes
We may release corrections, security updates, new activities or other changes. An update may be required for continued use or compatibility.
We may revise these Terms when the Services, legal requirements or business practices change. The revised Terms will be posted on this page with an updated date. Continued use after the effective date means the adult user accepts the revised Terms, to the extent permitted by law.
12. Suspension and termination
We may restrict or terminate access where reasonably necessary to address unlawful use, abuse, security risks, policy violations, technical problems or discontinuation of a Service.
A user may stop using a Service at any time and may uninstall an App from the device.
13. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available”. We do not guarantee that every Service will be uninterrupted, error-free, secure or compatible with every device, or that it will produce a particular educational result.
Nothing in these Terms excludes warranties, consumer rights or other protections that cannot lawfully be excluded.
14. Limitation of liability
To the extent permitted by applicable law, Learn With Fun Studio will not be liable for indirect, incidental, special or consequential loss arising from use of, inability to use or reliance on the Services, including loss of locally stored progress or incompatibility with a device.
This limitation does not apply where liability cannot legally be limited or excluded.
15. Privacy
Information handling for the website, web demos and Android Apps is described in our Privacy Policy. Parents and guardians should review that policy before a child uses a Service.
16. Applicable law
These Terms are governed by applicable law, without limiting any mandatory consumer-protection rights available in the user’s country or region. Any dispute should first be raised with us through the contact information below so that we can attempt to resolve it appropriately.
If any part of these Terms is found unenforceable, the remaining provisions will continue to apply.
